  • Bolsonaro was found guilty on five counts, including attempting a coup, participating in a criminal organization, and seeking to violently abolish the democratic rule of law.

What the Court Found

The case, known as Ação Penal 2668, was handled by the First Panel of Brazil’s Supreme Federal Court. Prosecutors alleged that after Bolsonaro lost the 2022 election, he conspired to undermine Brazil’s democratic institutions. Among the charges:

  • Trying to nullify election results through disinformation and manipulation of electoral authorities.
  • Attempting to enlist military intervention to prevent President Lula da Silva from taking office.
  • Plans or acts tied to the January 8, 2023 attack on Brasilia’s seat of government by Bolsonaro supporters.

Justice Alexandre de Moraes delivered the key vote and laid out much of the evidence; other judges including Flávio Dino, Cármen Lúcia, and Cristiano Zanin agreed with his findings. Luiz Fux dissented.

Sentencing & Ramifications

Bolsonaro’s sentence is 27 years and 3 months in prison. Other convicted individuals received sentences ranging from short terms of house arrest to over 20 years.

Though convicted, Bolsonaro remains under house arrest pending appeals. It is unlikely he immediately begins serving the sentence until the legal process is fully exhausted.

The verdict also renders Bolsonaro ineligible to hold public office in future elections under Brazil’s laws.

Wider Significance

This case marks the first time a former president of Brazil was convicted for attempting to subvert the democratic order.

It has been seen as a test of Brazil’s institutions and judicial independence. The trial has been highly polarizing internally, and has drawn international attention—including criticism from some foreign leaders who claim the case is politically motivated.

What Comes Next

Bolsonaro and his legal team intend to appeal. They may raise arguments about jurisdiction, the scale of evidence, whether panels had authority, or mitigating factors like his age and health.

The Supreme Court will publish the full ruling, which will allow for appeals to higher courts. If upheld, this sentence will significantly reshape Bolsonaro’s political future—and could influence how democracies confront similar challenges.
